MINUTES



Authority Chairman Jon Fleagle called the regularly scheduled meeting of the Waynesboro Borough Authority to order at 7:30 p.m. with the following in attendance:

 

Borough Authority Members – Lee Layman, Christopher Snively, Jon Fleagle and S. Allen Stine (Richard Starliper was absent)


          Borough Staff – S. Leiter Pryor, Director of Utilities

                     D. Lloyd Reichard, II, Borough Solicitor



APPROVE MINUTES: Approval of the April 15th minutes was deferred until the next meeting.


SOURCE DEVELOPMENT UPDATE: Leiter Pryor reported that he and Jim Valentine met with Mr. Hess at the well site to stake out an area (approximately 350x350 s.f.) around the well head so he could plant crops. Formal drawings should be available in the near future. In the meantime, Lloyd Reichard contacted Tim Ausherman to obtain a proposal for an appraisal of the property. After further discussion, Allen Stine made a motion to authorize Mr. Reichard to contact Mr. Hess’ attorney to see what he wants for the property. Once that figure is obtained, Leiter Pryor will contact the Authority members to determine whether or not to proceed with the appraisal. Christopher Snively seconded; the motion passed unanimously.


Leiter Pryor noted that the Authority talked about the possibility of removing the pump from the Stine well and utilizing it in the Hess well to see if the water clears after continuous pumping. He has made some inquiries, but doesn’t have a definitive answer. They are hoping to be able to pump in the fall.


Mr. Pryor provided Mr. Long with a revised agreement, pursuant to meeting with Gannett Fleming representatives regarding an alternate well site. Mr. Long seemed to be in agreement. He presented the proposed agreement for execution, along with a reimbursement request for $1,000. Mr. Pryor added that he has obtained a verbal agreement from Mr. Henicle for a temporary easement to gain access to the Long property. Allen Stine made a motion to approve the Long Agreement, including a reimbursement of $1,000 as agreed upon, as soon as a Right-of-Way Agreement has been executed with Mr. Henicle. Lee Layman seconded; the motion passed unanimously.


Allen Stine made a motion to authorize Chairman Fleagle to execute an Access Agreement with Michael Henicle immediately upon its preparation. Christopher Snively seconded; the motion passed unanimously.


Leiter Pryor noted that he met with Mr. Henicle and looked at his property off of Scott Road. He pointed out several locations that the Authority may want to consider for well drilling. Mr. Pryor asked for the Authority’s approval to have a geologist check these locations. Lee Layman made a motion to approve Mr. Pryor’s request for a geologist to view the sites. Christopher Snively seconded; the motion passed unanimously. Allen Stine will also look in the area around the Stine Well for possible well sites.


2002 AUDIT: Mr. Fleagle noted that there were some comments from the auditor regarding the sewer accounts and the trust indenture. Leiter Pryor explained, adding that the matter will be “squared away” by June 1st. The Authority members were given an opportunity to review the 2002 Water and Sewer audits, and noted no problems or questions. Lee Layman made a motion to accept the audits, subject to the changes recommended by the auditor to comply with the trust indenture of the Sewer Fund. Allen Stine seconded; the motion passed unanimously.


CARETAKER’S HOUSE – PORCH AND DECK: Leiter Pryor reported that the back deck on the caretaker’s house has been completed, and the footers have been dug for the front porch. He added that the contractor is behind schedule due to the weather.


DEP CERTIFICATE OF RECOGNITION: Mr. Pryor informed the Authority that a Certificate of Recognition was received again this year for meeting all DEP’s monitoring requirements. The Authority members requested that Mr. Pryor convey their congratulations to the Water Plant staff for a “job well done”.


THIRD STREET PUMPING STATION PROJECT UPDATE: Leiter Pryor noted that the contractor was on site recently and installed some electrical duct work and control units for the pumps. They are currently awaiting some additional equipment, but expect to “be in good shape” by the end of June. The projected completion date is mid-July. Inspections are conducted by Gannett Fleming as part of their contract, and the Borough’s Engineering Department has also been checking in periodically.


Mr. Pryor reported that the Third Street Pumping Station had a failure again. The telephone dialer alerted the staff and they were able to fix the problem before any damage was done.


The Northfield Avenue Pumping Station has been working well.


PROPOSAL – 2003 ANTIETAM DAM INSPECTION: Mr. Pryor discussed a proposal received from Denny Black for the annual inspection of Antietam Dam. He noted that he is also scheduled to inspect the outlet pipe and control tower this year. Christopher Snively made a motion to authorize Denny Black to do the annual inspection, including the outlet pipe and control tower. Lee Layman seconded; the motion passed unanimously.


Mr. Pryor presented pictures from the South Mountain Bible Church of the work they did on the water shed (at the cemetery), for the Authority’s review.


KELLER SPRING HOUSE: During the last discussion regarding this matter, it seemed to be the consensus of those present that the pumps and equipment from the Keller Spring House would be dismantled and sold; however, action was deferred until the majority of the Authority could be present. Mr. Stine explained that the property will revert back to the property owner if the Authority no longer uses it as a source of potable water. Jon Fleagle questioned notification procedures to be followed. Solicitor Reichard suggested a public notice of abandonment. It was also suggested that WTMA be advised that the Springs are being abandoned, and as a consequence, they will need to obtain a right-of-way for maintenance of the lines and access to the system. Christopher Snively made a motion to direct Leiter Pryor to advise WTMA that the Authority plans to abandon the Keller Springs, and that they should obtain a right-of-way for access to the valves and meters as a consequence. Mr. Pryor should also remove and salvage any equipment which could be sold. Allen Stine seconded; the motion passed unanimously.


PAY BILLS: Allen Stine made a motion to approve the payment of the following requisitions –

 

Sewer Requisition #828 - Smith Elliott Kearns & Company, LLC - $1,905.00 - Audit of financial statements and preparation and presentation of report thereon as of December 31, 2002, including preparation of DCED report and Notice of Audit (Less Progress Billing); additional services required due to new bond issue, including meeting with management and Trustee on March 4 and correspondence with Trustee regarding accounting and compliance matters.

 

Sewer Requisition #829 - Material Matters, Inc. - $1,284.15 - Environmental services in connection with preparation of a DEP Notice of Intent for approval under a Biosolids General Permit for the period from February 22, 2003 to April 4, 2003.

 

Sewer Requisition #830 - Gannett Fleming Companies - $3,608.86 - Annual Operations Related Services including: Part A – General Construction Phase Services Associated with the Third Street Pumping Station Rehabilitation for the period of February 22, 2003 through April 4, 2003.

 

Water Requisition #03-04 - Smith Elliott Kearns & Company, LLC - $2,080.00 - Audit of financial statements and preparation and presentation of report thereon as of December 31, 2002, including preparation of DCED report and Notice of Audit (Less Progress Billing); additional services required due to new bond issue, including meeting with management and Trustee on March 4 and correspondence with Trustee regarding accounting and compliance matters.

 

Water Requisition #03-05 - Gannett Fleming Companies - $85.96 - Engineering services rendered in connection with: Part A – Annual Consulting Services for the period February 22, 2003 through April 4, 2003.

 

Source Development Fund (Water Requisition) #SD-057 - Gannett Fleming Companies - $28.98 - Engineering services rendered in connection with: A. Stine Well (Well No. 1 - Zullinger) Feasibility Study for the period of June 29, 2002 thru August 23, 2003.

 

Source Development Fund (Water Requisition) #SD-058 - Gannett Fleming Companies - $8,999.42 - Engineering services rendered in connection with: Part A – Well Development Services Performed at the Authority’s Request, including Status Reports to Board, Additional Well Sites, etc.; and Part B – Well Development Services at Test Well Site No. 6 (Long Property), Performed at the Authority’s Request, including Status Reports to Board, Additional Well Sites, etc. for the period of January 25, 2003 through April 4, 2003.
