MINUTES



Authority Chairman Jon Fleagle called the regularly scheduled meeting of the Waynesboro Borough Authority to order at 7:30 p.m., with the following in attendance:

 

Borough Authority Members – Jon Fleagle, William Pflager, Christopher Snively and Lee Layman (Allen Stine arrived at 8:05 p.m.)

APPROVE MINUTES: Christopher Snively made a motion to approve the minutes of the July 18, 2006 meeting, as written. Lee Layman seconded; the motion passed unanimously.


SOURCE DEVELOPMENT UPDATE: Leiter Pryor reported that he is in the process of completing the 537 module for the pump station at the McCleaf Well, with Gannett Fleming’s assistance. As soon as signatures are obtained from Washington Township and the Franklin County Planning Commission, the module will be submitted to DEP. He added that this module is the only outstanding item required for the Land Development Plan.


Mr. Pryor also reported that DEP’s comments regarding the Water Supply Permit Application were received and Gannett Fleming is preparing a response. He added that there was “nothing major”, and the permit should be forthcoming in the near future.


In addition, a check was received from DCNR for the land acquisition grant. The $63,568 check was deposited into the Source Development Fund as reimbursement for costs involved in the acquisition.


A detailed set of drawings for the treatment building at the McCleaf Well will be available for the Authority’s review at their next meeting.


Discussion followed regarding the need for an upgrade at the West Penn Pumping Station. Mr. Pryor noted that the matter is “on the back burner” at the present time; but when the well project is bid, the pump station upgrade will be included in the scope of the project.


HOMETOWN HOMES: Merle Holsinger was present to discuss Hometown Homes’ proposed townhouse development at the south end of town (in the area of S. Church Street and the old railroad). He discussed several issues with regard to the development, including the number of roadway cuts that would be required to provide water and sewer service to the units. Rather than making numerous cuts on S. Church Street and E. Ninth Street, they are proposing to run the sewer lines parallel to the units and the road, which would only require the road to be cut in one place on each street. They have also considered running the water lines parallel as well. Discussion followed regarding the shallow rock on S. Church Street and the attempt being made to minimize the impact on the roads because they were recently paved. Representatives of Hometown Homes met with the Borough’s Street Committee, and it was decided that one tap vs. 37 taps would be a benefit to the integrity of the sewer line as well.


It was noted that it will be the responsibility of the Homeowners’ Association to operate and maintain the sewer line and laterals. Leiter Pryor stated that an agreement should be entered into regarding maintenance of the private lines. A draft agreement should be submitted to the Authority for review when the Applications for Water/Sewer Main Extension are presented. Authority Solicitor Lloyd Reichard stated that this would be a deviation to what the WBA has historically done. Mr. Holsinger added that there are other factors within this project that make it mandatory for the Homeowners’ Association to remain intact.


Discussion continued regarding other alternatives regarding the private lines. The possibility of granting an easement to the WBA for inspection only was mentioned. All parties involved seemed agreeable that the WBA should have the right to do inspections, at will, on the private lines. A draft agreement to this effect will be presented at the time the Applications for Water/Sewer Main Extensions are presented.


UPDATE - TANK COATING AT WATER TREATMENT PLANT: Leiter Pryor reported that several members of the Water Plant staff were recently certified in vapor barrier application. Materials have been ordered, and the tank coating at the Water Plant will begin the following day. They are still pursuing media removal/replacement, and he will report on the project at the Authority’s next meeting.


WATER SERVICE LINE LEAK - PRICES CHURCH ROAD: Leiter Pryor reported that he was informed by Mr. Blair that the problem would be resolved within two (2) weeks, however no details were provided on his plan of action. Mr. Pryor gave him information on leak detection and recommended that the private service line be replaced. In the meantime, water usage is being tracked through the master meter (an additional 360,000 gallons has been utilized to date) and will be billed accordingly. Chairman Fleagle noted that Mr. Blair should be put on notice that if repairs are not made by the end of the month, his water service will be terminated.


CORPORATE RESOLUTION - HOLLENGREEN UTILITY ESCROW ACCOUNT: Leiter Pryor presented a Corporate Resolution required for the Hollengreen Utility Escrow Account, as the wrong paperwork was executed previously. Allen Stine made a motion to approve execution of the Corporate Resolution, as presented. William Pflager seconded; the motion passed unanimously.


UTILITY SERVICE - GLEN OAKS DEVELOPMENT: Leiter Pryor noted that he received a telephone call from Gene Barnhart (WTMA) regarding sewer service for the proposed Glen Oaks Development on Route 16. As there are currently other commitments, Mr. Pryor noted that a study should be conducted to ensure sufficient capacity at the Third Street Pumping Station. He added that there has not been a formal request submitted by WTMA yet, and no engineering design or review fees have been collected to date. It was suggested that the WBA should charge $500.00 each for water and sewer for the required studies.


WATER CAPACITY REQUEST - CINETIC LANDIS GRINDING CORPORATION: Leiter Pryor presented a Water Capacity Request from WTMA for Lot #5 of the Wharf Road Industrial Park, which would involve 23 EDU’s. No problems were noted; Leiter Pryor was instructed to reply accordingly.


REQUEST FOR REIMBURSEMENT: Leiter Pryor explained that Mr. Rinks had constructed a sewer main extension in 1994. His neighbor’s sewer system failed and he connected to the Borough line that Mr. Rinks’ constructed; and Mr. Rinks is requesting a reimbursement for the collection portion of his construction. (His cost in 1994 was approximately $6,000.) In the past, it has been the WBA’s policy that when an individual connects to a privately-constructed line, the person who paid for the original construction is reimbursed the collection portion of fees paid. Mr. Pryor reviewed details of the Sewer Main Extension Agreement and the construction work done by the Borough. He recommended that mr. Rinks be reimbursed the requested $1,000. William Pflager made a motion to authorize Leiter Pryor to reimburse Mr. Rinks the requested collection fee of $1,000. Christopher Snively seconded; the motion passed unanimously.


TIMBER THEFT: Leiter Pryor noted that he received correspondence from the court regarding the recent timber theft at the watershed. An arraignment date of August 21st has been set. Costs of $6,300 have been calculated and will be submitted to the court as the WBA’s claim for damages. Authority Solicitor Reichard noted that double damages can be requested and he recommended that they be pursued. Based on the Solicitor’s recommendation, the Authority agreed to seek double damages for the timber theft.


LEAK AT ANTIETAM COMMONS: Leiter Pryor reported that the contractor (Pave-X) has been billed for the water leak at the Antietam Commons (behind the Wayne Heights Mall). The Authority’s asked if he had also billed them for water loss; and Leiter Pryor was instructed to calculate those damages and submit a revision to the previous invoice.


PAY BILLS: Allen Stine made a motion to approve the payment of the following requisitions –

 

Water Requisition #06-16 - Gannett Fleming Companies - $4,021.96 - Preliminary studies related to inspection and evaluation of the seepage problem at the Water Treatment Plant for the period of May 27, 2006 through June 23, 2006

Sewer Requisition #878 - The Pennsylvania State University - $325.00 - 1 DEP Permit 271-Biosolids

 

Source Development Fund (Water Requisition) #SD-137 - Gannett Fleming Companies - $1,081.79 - Preliminary design of Well No. 2 membrane facilities to support permitting approvals for the period of May 27, 2006

                     through June 23, 2006

 

Source Development Fund (Water Requisition) #SD-138 - Washington Township Supervisors - $220.89 - Engineering fees for review of Well #2 land development for the period of 06/18/06 to 07/15/06


William Pflager seconded; the motion passed unanimously.


Having no further business to discuss, the meeting adjourned at 8:56 p.m. on a Layman/Pflager motion which passed unanimously.
