PUBLIC HEARING RE: VACATING A PORTION OF A 15' UNOPENED ALLEY FROM ITS INTERSECTION WITH BROWN STREET, BEING A LENGTH OF 81.56 FEET
Council President Richard George called the public hearing to order at 7:15 p.m. with the following in attendance:
Borough Council – Allen Porter, Jason Stains, Craig Newcomer, Richard George, Charles McCammon and Allen Berry
Mayor Richard Starliper
Borough Staff – Lloyd R. Hamberger, II, Borough Manager
Melissa Dively, Borough Solicitor (Salzmann Hughes, PC)
Denny Benshoff, Maintenance Superintendent
Dan Sheffler, Zoning-Code Enforcement Officer
Kevin Grubbs, Head of Engineering Services
The purpose of the hearing was to discuss a proposed ordinance regarding vacating a portion of a 15' unopened alley in the Borough of Waynesboro, from its intersection with Brown Street, being a length of 81.56 feet. The hearing was duly advertised in The Record Herald on December 19th and December 26th, 2006. Those wishing to comment for the record were asked to rise, and Mr. George administered the oath.
Kevin Grubbs testified to the following –
• November 7, 2006 - Received request to vacate alley.
• November 8, 2006 - Delivered to Franklin County Planning Commission for review and comments.
• November 13, 2006 - Reviewed by Waynesboro Planning Commission and recommended to Borough Council to proceed with vacation of alley.
• November 15, 2006 - Reviewed by Borough Council and approved advertisement of the ordinance and public hearing scheduled for January 3, 2007.
• November 30, 2006 - Prepared ordinance and sent copy to Borough Solicitor for review.
• December 19, 2006 - Advertised ordinance in The Record Herald.
• December 22, 2006 - Mailed certified copy of Legal Notice to residents.
• December 22, 2006 - Posted perimeter of alley with Legal Notice.
• December 26, 2006 - Mailed copy of Legal Notice to residents in area not directly adjacent to vacation.
• December 26, 2006 - Second advertisement of ordinance and Public Hearing Notice in The Record Herald.
• January 3, 2007 - Received review comments from Franklin County Planning Commission for approval of vacation.
A. J. Benchoff, attorney representing Ronald Martin: Mr. Benchoff stated that a Quit Claim Deed was submitted to Solicitor Melissa Dively, which will deed half of the 15' unopened alley to Ronald Martin (the Borough will acquire the remaining half). He referenced meets and bounds as delineated in a survey prepared by R. Lee Royer and Associates, indicating that this would “continue the abandonment” done previously.
Hearing no further comments, the hearing adjourned at 7:16 p.m.
