                                                                WORKSHOP MEETING



President Craig Newcomer called the meeting to order at 6:30 p.m. with the following in attendance:

 

Councilmen – Craig Newcomer, C. Harold Mumma, Ronald Martin, Wayne Driscoll and Ben Greenawalt (Jason Stains arrived during the meeting)

The purpose of the meeting was to discuss two items: the proposed amendment to the Borough’s Building Code Ordinance and the proposed Jay Walking Ordinance.


BUILDING CODE: The Borough Manager explained the reason for the amendment was to “undelete” the provisions of the International Building Code that were deleted by the State when it adopted the “Uniform Construction Code (UCC) of Pennsylvania”.


The sections that were deleted are noted in a handout provided, a copy of which is attached, as well as the proposed ordinance. A lengthy discussion arose regarding the particular section of the Code and the interpretation of the Code by the Building Official regarding “what is a structural modification; and under which circumstances is a permit required for plumbing, HVAC, furnaces and electrical modifications?” Generally, if there is a replacement of “like for like” at the same location or relocation within the structure, no permit is required.


Discussion also evolved regarding enforcement, blanket permits and other procedural items. The matter was deferred, and any questions should be forwarded to the Borough staff prior to the next Council meeting.


JAY WALKING ORDINANCE: Kevin Grubbs presented the modified ordinance. The provision prohibits jay walking only in the Town Center and Central Business zones, and only between regulated (signalized) intersections. A discussion arose regarding potential liability in non-enforced areas. The Solicitor will review the matter and will report at the next meeting.
