Council President Craig Newcomer called the regularly scheduled meeting of the Waynesboro Borough Council to order at 7:30 p.m. with the following in attendance:

PLEDGE OF ALLEGIANCE: Mayor Starliper led those present in the Pledge of Allegiance.


APPROVE MINUTES: Councilman Greenawalt made a motion to approve the minutes of the June 9th meeting, as written. Councilman Driscoll seconded; the motion passed unanimously.


ACCEPT REPORTS: Councilman Martin made a motion to accept the reports of the Fire Chief, Police Chief and Code Enforcement Officer for the month of May, 2010, as presented. Councilman Greenawalt seconded; the motion passed unanimously.


COMMITTEE REPORTS


PERSONNEL COMMITTEE: Councilman Mumma noted he will present two (2) items during the “voting” section of the meeting.


PROPERTY AND PUBLIC SAFETY COMMITTEE: No report.


STREET COMMITTEE: Councilman Martin noted he will also present several items during the “voting” section.


INTERGOVERNMENTAL COMMITTEE: Councilman Stains reported that Comcast will increase TV cable rates by approximately $3.00-$4.00/month.


DOWNTOWN REVITALIZATION COMMITTEE: No report.


FINANCE COMMITTEE: Councilman Greenawalt reported on finances, as follows –

MAYOR’S REPORT: The Mayor’s Report was as follows –

 

“On June 14th, Chief King and myself attended the “State of Drug and Alcohol Use in Franklin County” at Rhodes Grove Conference Center. As all of us are aware or should be aware, there is a growing problem in Franklin County. Franklin and Fulton Counties have a higher-than-state-average use in reference to alcohol, tobacco and other substance-abuse items.

 

On the 25th, I attended the Chamber’s TGIF Breakfast at Mountain Gate.

 

Also on the 25th, I attended the Battle of Monterey Pass Committee meeting. It would or could impact the Waynesboro area as to economics is concerned.

 

On June 25th, I attended the Cumberland Valley Amateur Radio Club’s Field Day at Twin Bridges Campground. Amateur radio operators or ham operators are very important in a time of emergency.

 

On July 3rd, I participated in the Brothers of the Brush parade and the Summer Jubilee activities. Our thanks go out to these two volunteer organizations for their community support.

 

On July 5th, along with Borough Manager Hamberger, I attended the concerT by the 257th Army Band. Once again, a great presentation by our local Wayne Band and Summer Jubilee personnel.

 

Hans Bader, our Emergency Management Coordinator, attended and is a member of the Keystone Emergency Management Association.

 

On June 1st, the Waynesboro Police Department presented Chris Guyer with a Certificate of Appreciation for his contribution in helping to locate and obtain additional cell keys. Thank you.

 

On June 1st, the Waynesboro Police Department received a Certificate of Appreciation from the Pennsylvania Aggressive Driving Enforcement and Education Program. Also, Officer Rebekah Deeds was recognized for her valuable contribution to the 2009 program.”


SOLICITOR’S REPORT: No report.


PUBLIC COMMENT - ITEMS ON AGENDA: None.


VOTING ON ITEMS FROM COMMITTEE REPORTS: Councilman Mumma made a motion to affirm the hiring of Trevor Stewart as a Golf Course Maintenance Worker. Councilman Stains seconded; the motion passed unanimously.


Councilman Mumma made a motion to approve a 25¢ salary increase and paid holidays for Vicky Grubbs, Temporary Clerk/Bookkeeper (her new hourly rate will be $10.25). Councilman Martin seconded; the motion passed unanimously.


Councilman Martin reported that paving on Main Street will be done at night to alleviate traffic flow problems, but Council members will probably hear complaints from the public regarding the noise. In addition, he noted that construction on E. Second Street will begin approximately July 12th.


Councilman Martin made a motion to designate a 25' “no parking” area on the west side of S. Price Avenue, south of Main Street. Councilman Greenawalt seconded; the motion passed unanimously.


Councilman Martin reported that the Street Committee is recommending the installation of PENNDOT-approved flashing yellow lights on the crosswalk signs at the following locations to make them more visible to motorists (since the roadway cannot be painted with yellow paint): N. Grant/Brown Streets, Main/Walnut Streets, Main Street at the Hospital, Main Street/Mulberry Avenue, Main Street/Cleveland Avenue and Main Street at the Waynesboro Mall. After reviewing costs of the battery-operated vs. solar-powered lights, Councilman Martin made a motion to approve the use of solar-powered strobe lights (60 flashes per minute) on the aforementioned crosswalks. Councilman Greenawalt seconded; the motion passed unanimously.


UNFINISHED BUSINESS


PROPOSED ORDINANCE RE: ALCOHOLIC BEVERAGES ON BOROUGH PROPERTY:

Mr. Hamberger noted that Solicitor Dively drafted a proposed ordinance to permit alcoholic beverages at the Municipal Golf Course during tournaments only. Councilman Martin made a motion to authorize advertisement of the proposed ordinance for Council’s consideration at their next meeting. Councilman Driscoll seconded; the motion passed unanimously.


PROPOSED ORDINANCE RE: UNIFORM CONSTRUCTION CODE (UCC): Mr. Hamberger noted that he forwarded the proposed ordinance regarding amendments to the UCC to Council for review and comments. If there are no objections from Council, the proposed ordinance must be sent to the PA Department of Labor and Industry. A public hearing will be scheduled for the second meeting in August, and the ordinance will be considered for adoption by Council at the regular meeting following the hearing. Councilman Greenawalt made a motion to authorize the Borough Manager to proceed. Councilman Mumma seconded.


Discussion followed regarding wording in the proposed ordinance indicating that a permit would not be required for HVAC replacement “with like size and volume”. Ms. Dively suggested removing “volume”, and Councilman Greenawalt amended his motion to include this modification. Councilman Mumma seconded the amended motion, which then passed unanimously.


NEW BUSINESS


SPECIAL FIRE POLICE ASSISTANCE AGREEMENT WITH GREENE TOWNSHIP AND THE FAYETTEVILLE VOLUNTEER FIRE DEPARTMENT: Mr. Hamberger explained that this agreement is similar to fire police agreements the Borough has signed in the past. Solicitor Dively agreed that it is common between municipalities. Councilman Greenawalt made a motion to approve the proposed Special Fire Police Assistance Agreement with Greene Township and the Fayetteville Volunteer Fire Department. Councilman Stains seconded. Councilman Martin questioned if the Fire Chief is “on board” with this. Mayor Starliper explained that, even though the Fire Police are under the Police Department, he feels sure that the Fire Chief would have no problem with it. He added that this agreement delineates mutual aid to be provided and alleviates potential liability issues. The motion then passed unanimously.


ILLUMINATED STREET SIGNS ON MAIN STREET: Councilman Martin reported that the Street Committee and staff met with Andrew Papoutsis of APX SignTek of Mercersburg. Mr. Papoutsis has agreed to donate (at no charge) 17 lighted signs for use at the Main Street intersections of Grant Street, Potomac Street, Church Street, Broad Street, Clayton Avenue, Roadside Avenue and Virginia Avenue. The Borough’s responsibility would be to light them. The staff is checking with PENNDOT to ensure that they will permit the lighted signs on the state roadway (and it appears that they will). Star Electric, who has done a lot of work with lighting around traffic lights, will provide a price quote for the installation. No objections were noted. The staff will proceed and report back.


PUBLIC IN ATTENDANCE - NON-AGENDA ITEMS: Leon Adler, Owner and President of the American Eagle Door Store, was present representing the newly-formed Waynesboro Business Community Partnership. He noted they are looking for permission from Council for food vendors to be positioned in Center Square on September 18th, in conjunction with themes at the Elks Club, Eagles Club and the American Legion. The group is also planning to have a “Santa House” built and placed downtown from November 30th to January 1st. After the holidays, it will be auctioned off and the proceeds divided between his organization and the Vo-Tech class who builds it. Councilman Martin suggested they coordinate with Pat Fleagle (Downtown Manager) to ensure there are no conflicts with other events planned at that time. Mr. Fleagle was present and noted that the group has already been in contact with him.


Council President Newcomer recommended that the request(s) be placed in writing and presented to Council for consideration at their next meeting scheduled for Thursday, July 22nd.


SEWER RATE INCREASE: Councilman Martin noted that Council met with WBA members and staff during their workshop prior to this meeting, and discussion was held regarding the upcoming DEP-mandated upgrades at the Sewer Treatment Plant. The WBA is requesting that Council approve a 15% increase in sewer rates to begin August 1st, and he made a motion to adopt Resolution 2010-06 accordingly. Councilman Driscoll seconded; the motion passed unanimously.

          WHEREAS, the Borough Council of the Borough of Waynesboro has adopted a Sewer Use Ordinance, and

SCHOOL RESOURCE OFFICER: Councilman Martin requested that the Memorandum of Understanding regarding this matter be reviewed and discussed at the next meeting. He noted that the agreement is to expire on 06/30/2012 unless it is terminated by mutual agreement of both parties.


APPLICATION FOR GENERAL PERMIT FOR GAS-FIRED BOILERS AT LANDIS COMPLEX: Mr. Hamberger noted that this is standard notification that D. L. George is applying to DEP for a general permit for two (2) natural gas-fired boilers at the Landis Complex. There is a thirty (30) day comment period.

COMPLETION OF NATIONAL RECREATION AND PARK ASSOCIATION (NRPA) CERTIFIED PLAYGROUND SAFETY INSPECTOR EXAMINATION (SCOTT CRUM): Mr. Hamberger reported that Scott Crum was recently re-certified by the NRPA as a Playground Safety Inspector. With this certification, he is able to inspect the Borough’s playground equipment (which helps to keep the insurance rates low). He noted that Scott should be commended for his efforts.


PAY BILLS: Councilman Mumma made a motion to approve the payment of Voucher Lists dated 06/09, 06/16, 06/22 and 06/30. Councilman Stains seconded; the motion passed unanimously.


COUNCIL AND STAFF COMMENTS: As briefly mentioned earlier in the meeting, Mr. Hamberger announced that Council’s next meeting has been rescheduled from Wednesday, July 21st, to Thursday, July 22nd. This change will be advertised in The Record Herald.


Councilman Driscoll noted that he has been an active member of the Summer Jubilee Committee for the last 7-8 years. The group begins meeting each December to coordinate the events, and each year he is amazed at the turnout of attendees. He added that he is proud to be a part of the Committee, and hopes that everyone appreciates the amount of work this group of people does for the community.


Councilman Martin added favorable comments to those of Councilman Driscoll regarding the fireworks display and parade sponsored by the Brothers of the Brush. He asked for a round of applause for everyone who worked to make the July 4th holiday weekend what it was.


Having heard the news that Solicitor Dively will be retiring, Councilman Martin stated that it has been a “real privilege” to have had her serve as the Borough’s counsel. Ms. Dively noted that she will be attending Council’s next meeting scheduled for July 22.


Denny Benshoff drew attention to the fact that there are new traffic patterns in the area of Clayton Avenue/Ninth Street and Old Mill Road/Ninth Street, as they put new stop signs (with blinking lights) in-service today.


Police Chief Mark King reminded Council and the public of the National Night Out event to be held on August 3rd from 6-8 p.m. at Memorial Park. He reviewed the activities they have planned.


Councilman Greenawalt noted his appreciation to those who attended this evening’s meeting. He also advised that he will be having back surgery the following week.


Councilman Stains echoed Councilman Driscoll’s comments regarding the Summer Jubilee activities.


Councilman Mumma agreed with Councilman Martin’s comments with regard to Melissa Dively, adding that he will miss her knowledge, enthusiasm and willingness to assist. It was noted that Sam Wiser from Salzmann Hughes will be taking her place.


Mayor Starliper noted that Fire Marshall Jerry Hartman will be putting together information/recommendations regarding the sale of fireworks in the Borough, as a home in Smithsburg recently burned down because of the careless use of sparklers.


Having no further business to discuss, Councilman Greenawalt made a motion to adjourn the meeting at 8:16 p.m. Councilman Driscoll seconded; the motion passed unanimously.
