PUBLIC HEARING RE: FLOODPLAINS
Council President C. Harold Mumma called the public hearing to order at 7:15 p.m. with the following in attendance:
Borough Council Members – Benjamin Greenawalt, Craig Newcomer, Jason Stains, C. Harold Mumma, Wayne Driscoll and Ronald Martin
Mayor Richard Starliper
Borough Staff – Lloyd R. Hamberger, II, Borough Manager
Denny Benshoff, Maintenance Superintendent
Dan Sheffler, Zoning-Code Enforcement Officer
Kevin Grubbs, Head of Engineering Services
Sam Wiser, Borough Solicitor (Salzmann Hughes, PC)
Jason Cohen, Assistant Borough Manager
Mark King, Police Chief
Dave Martin, Fire Chief
Mr. Mumma noted that the purpose of this hearing was to discuss the proposed Floodplain Management Ordinance, and amendments to the Zoning Ordinance and Subdivision/Land Development Ordinance regarding floodplains. The hearing was duly advertised in The Record Herald on December 15th and December 22nd, 2011. The oath was administered to those wishing to comment for the record; and the Borough staff was requested to give a brief synopsis of the proposals and testimony regarding advertisements, notices, etc.
Kevin Grubbs testified to the following:
• December 6, 2011 - Delivered copies of ordinances to Franklin County Planning Commission and Franklin County Law Library.
• December 12, 2011 - Reviewed by Waynesboro Planning Commission and recommended approval of ordinance and amendments (on a 5-1 vote) to Borough Council.
• December 14, 2011 - Borough Council approved advertisement of public hearing scheduled for January 3, 2012 at 7:15 p.m.
• December 15, 2011 - Posted copy of ordinances in lobby of Borough Hall.
• December 15, 2011 - First advertisement of proposed ordinance and amendments in The Record Herald newspaper.
• December 22, 2011 - Second advertisement of proposed ordinance and amendments in The Record Herald newspaper.
• December 27, 2011 - Received proof of publication from The Record Herald for advertisement of ordinance and amended ordinances.
• January 3, 2012 - Received review comments from Franklin County Planning Commission. Recommended by County Planner that all proposed ordinance amendments be approved (see letter dated 01/03/12).
Solicitor Sam Wiser explained that these amendments will address mandatory changes that FEMA has required that the Borough make to be in compliance with the Flood Insurance Program. If these changes are not made, FEMA will no longer issue Flood Insurance Certificates (and there would no longer be real estate transactions in the Borough, as closures require a Flood Insurance Certificate).
Council President Mumma pointed out that, after the Floodplain Management Ordinance has been adopted, Council can subsequently make changes to it as they see fit. Solicitor Wiser added that FEMA must be notified of any proposed changes, and recommended that those not be made in the near future.
Hearing no further comments, the hearing was closed at 7:20 p.m.
