PUBLIC HEARING RE: AMENDMENT TO SUBDIVISION/LAND DEVELOPMENT ORDINANCE
Council President C. Harold Mumma called the public hearing to order at 7:30 p.m. with the following in attendance:
Borough Council Members – Benjamin Greenawalt, Craig Newcomer, Jason Stains, C. Harold Mumma, Wayne Driscoll and Ronald Martin
Mayor Richard Starliper
Borough Staff – Lloyd R. Hamberger, II, Borough Manager
Dan Sheffler, Zoning-Code Enforcement Officer
Mike Benshoff, Maintenance Foreman
Kevin Grubbs, Head of Engineering Services
Sam Wiser, Borough Solicitor (Salzmann Hughes, PC)
Jason Cohen, Assistant Borough Manager
Mr. Mumma stated the purpose of the hearing was to discuss and receive input on a proposed amendment to Ordinance No. 944, the Waynesboro Subdivision and Land Development Ordinance (SALDO). The hearing was duly advertised in The Record Herald on July 12, 2011. The oath was administered to those wishing to comment for the record. The Borough staff was asked to give a brief synopsis of the proposed changes and testimony regarding advertisements, notices, etc.
Kevin Grubbs outlined the proposed amendment to Article VIII, Subsection VIII-2, as follows --
• All improvements specified and approved on the final approved plat shall be installed, constructed and completed in accordance with the approved plat and with all design standards and improvement procedures specified by the Director of Borough Engineering.
• All public improvements specified and approved on the final approved plats shall be installed within two (2) years of the date of recording the plat, or prior to development of sixty (60) percent of the lot or lots on the approved plat, whichever occurs first. An extension of one (1) year may be requested from Borough Council, if such extension request is submitted to the Director of Borough Engineering in writing at least three (3) months prior to the required completion date of the public improvements. The granting of such extension is within Borough Council’s sole discretion.
He testified to the following –
• June 6, 2011 - Delivered copy of proposed amendment to Franklin County Planning Commission for review and comments. No comments received; therefore, deemed approved by them.
• June 13, 2011 - Proposed amendment was reviewed by the Waynesboro Planning Commission. Recommendation to Borough Council was made to proceed with adoption of proposed amendment.
• June 15, 2011 - Borough Council reviewed proposed amendment and approved the advertisement of the legal notification to hold a public hearing on July 20, 2011 at 7:30 p.m.
• July 12, 2011 - The advertisement of the legal notice to hold a public hearing and to consider the proposed amendment for adoption was published in The Record Herald newspaper.
Copy of the legal notice for advertisement was posted in the lobby of Borough Hall.
Comments from the public were requested. Hearing none, the hearing was adjourned at 7:34 p.m.
