Council President Charles McCammon called the regularly scheduled meeting of the Waynesboro Borough Council to order at 7:30 p.m. with the following in attendance:



Borough Council Members - Richard George, Jahnathan Cain, John Cook, Charles McCammon, Ardie Winters and Andrew Benchoff



Mayor Louis M. Barlup, Jr.



Borough Staff - Lloyd R. Hamberger, II, Borough Manager

Denny Benshoff, Maintenance Superintendent

Kevin Grubbs, Assistant Director of Engineering

D. Lloyd Reichard, II, Borough Solicitor

PLEDGE OF ALLEGIANCE: Mayor Barlup led those present in the Pledge of Allegiance.



APPROVE MINUTES: Councilman Cook made a motion to approve the minutes of the January 5, 2004 meeting, as written. Councilman Winters seconded; the motion passed unanimously.



ACCEPT REPORTS: Councilman George made a motion to accept the reports of the Building Inspector, Fire Department and Police Chief, as presented. Councilman Cain seconded; the motion passed unanimously.



COMMITTEE REPORTS: Council President McCammon noted that committee appointments will be presented later in the meeting. As new committees have not yet met this month, there were no reports.



MAYOR'S REPORT: No report.



BUS SERVICE (CTA) REPORT: Councilman Winters reported that he has not been able to attend any recent meetings in Chambersburg, but added that the bus service continues in Waynesboro on Tuesdays and Thursdays each week.



PUBLIC COMMENT - ITEMS ON AGENDA: None.



UNFINISHED BUSINESS



RENFREW APPOINTMENTS: Council President McCammon noted that appointments to the RCI Board will be established in February.



DEPUTY FIRE CHIEF APPOINTMENTS: Mr. McCammon noted that Deputy Fire Chief appointments will be tabled until an executive session is held at the end of this meeting.



UNIT DEBT ACT RESOLUTION AND LOAN DOCUMENTS: Mr. Hamberger noted that he and the Solicitor have prepared the required loan documents for the purchase of property at 100 Middle Street. He presented proposed Resolution #04-02, which would authorize borrowing money for capital projects through the Unit Debt Act. Councilman Cook made a motion to approve Resolution #04-02. Councilman Winters seconded; the motion passed unanimously.



RESOLUTION #04-02



RESOLUTION AUTHORIZING

SMALL BORROWING FOR CAPITAL PURPOSES

UNDER SECTION 8109 OF THE LGUDA



WHEREAS, the Borough of Waynesboro of Franklin County, Pennsylvania, hereinafter called the Local Government Unit, proposes to incur non-electoral debt by the issuance of a general obligation note to finance the costs of the following project: Purchase of 100 Middle Street, Waynesboro, PA; and

2004 BUDGET: Mr. Hamberger noted that Council members can discuss their concerns, if any, regarding opening the 2004 budget for further consideration. No comments were voiced from Council.



NEW BUSINESS



COMMITTEE APPOINTMENTS: President McCammon presented Council members with a list of committee appointments and asked if they were satisfied with their assignments. Several changes were made, and it was noted that a copy of the appointments will be provided to the press for publication.



FAIR HOUSING RESOLUTION (NO. 04-01): Mr. Hamberger presented proposed Resolution #04-02 for Council's approval. He noted that this resolution must be passed yearly as a part of the CDBG program, and states the Borough's policy on encouraging fair housing in accordance with Title VIII of the Civil Rights Act of 1968 (Federal Fair Housing Law) and the Pennsylvania Human Relations Act. Councilman Cook made a motion to approve Resolution #04-01. Councilman Benchoff seconded; the motion passed unanimously.



RESOLUTION #04-01



FAIR HOUSING RESOLUTION



LET IT BE KNOWN TO ALL PERSONS of the Borough of Waynesboro that discrimination in the sale, rental, leasing, financing of housing or land to be used for construction of housing, or in the provision of brokerage services because of race, color, religion, ancestry, sex, national origin, handicap or disability is prohibited by Title VIII of the Civil Rights Act of 1968 (Federal Fair Housing Law) and the Pennsylvania Human Relations Act. It is the policy of the Borough of Waynesboro to implement programs to ensure equal opportunity in housing for all persons regardless of race, color, religion, ancestry, sex, national origin, handicap or disability, or familial status (families with children). Therefore, the Borough of Waynesboro does hereby pass the following Resolution.

CTA RECOVERY PLAN: Mr. Hamberger reported that he received a copy of the Chambersburg Transit Authority (CTA) Recovery Plan. As it is quite voluminous, he did not provide individual copies for each Council member; however, anyone wishing to view it or receive a copy should let him know.



DOWNTOWN VACATED SIGNS: Harry Morningstar, 205 Clayton Avenue. Mr. Morningstar noted that he made a recent visit to the Building Inspector's office in an attempt to have numerous signs removed from Main Street that have not been used for an extended period of time. He noted that the businesses have been closed and/or the buildings have been vacated, but the signs remain. He was informed, however, that there are no regulations in the Borough which require a property owner to remove signs that are no longer in use. Council President McCammon informed Mr. Morningstar that certain changes are being made in the existing Building Code, and this matter will be considered for inclusion in the modification.



Mr. Morningstar also questioned when the Christmas decorations will be removed from the downtown area. Mr. McCammon responded that, in the past, those have remained until the end of January. As volunteers currently install and remove the banners and wreathes, Mr. Morningstar asked if there was a possibility that this duty could be diverted to Borough personnel (which would also alleviate certain liability issues involved). Mr. McCammon noted that the decorations are owned by the Retail Bureau, and he is unsure if the Borough would want to take on that responsibility or not.



PUBLIC IN ATTENDANCE - NON-AGENDA ITEMS: Ronald Martin, 1625 E. Main Street. Mr. Martin noted that each year since 1999 to the present, the Borough of Waynesboro has had a tax increase. He stated that the Council is "taxing people out of their houses". Many residents are retired and live on fixed incomes. He suggested that Council work on developing a plan to increase their tax base so a tax increase is not necessary in the upcoming year. He noted that he would like to see a proposal regarding this matter by the second meeting in February. In addition, Mr. Martin voiced his opinion that the concept of a downtown manager is "totally wrong at this time". He feels that the money which would be utilized for a manager could be put to use to help in different ways.



Vicki Huff, 28 E. Main Street. Mrs. Huff questioned if Council intends to make its committee appointments public. President McCammon noted that interested individuals may view the appointments at Borough Hall, and the information will be provided to the press for publication.

REMINDER OF TRI-COUNTY BOROUGHS ASSOCIATION MEETING: Mr. Hamberger reminded Council that the Central Tri-County Boroughs Association meeting will be held on January 27th at 7:00 p.m. in Greencastle.



PAY BILLS: Councilman Cook made a motion to approve the payment of Voucher List VL-04-01. Councilman Cain seconded; the motion passed unanimously.



COUNCIL AND STAFF COMMENTS: Councilman Winters suggested that Richard Mohn be considered for an appointment to the RCI Board. Councilman George and Mayor Barlup noted that that matter was brought before Council at a previous time.



Kevin Grubbs reported that the 25 mph signs have been installed on Prices Church Road. Only one sign remains to be installed, and they are awaiting notification to the appropriate utilities before that can be done. In addition, Mr. Grubbs noted that the "No Parking" signs at Fairview Avenue and the north side of W. Third Street have been installed.



Councilman George gave credit to Mr. Hamberger for his proposed correspondence regarding the Patriot Act. It was suggested that Council review the letter for action at their next meeting.



Councilman Cain made a motion to authorize the Waynesboro Civil Service Commission to administer an examination for the position of Patrolman in the Waynesboro Police Department. Councilman Cook seconded; the motion passed unanimously. Mr. Cain thanked the public in attendance for their interest, and added he hopes to see them again at the next public hearing and future Council meetings.



Mayor Barlup noted he is looking forward to an outstanding year with the new Council members on-board.



Council recessed at 7:55 p.m. for approximately 10 minutes, and adjourned to executive session at 8:05 p.m. for the purpose of discussing personnel matters. They reconvened to regular session at 8:28 p.m. and adjourned the meeting at 8:29 p.m. on a George/Cook motion which passed unanimously.
