Council President Charles McCammon called the regularly scheduled meeting of the Waynesboro Borough Council to order at 7:30 p.m. with the following in attendance:

PLEDGE OF ALLEGIANCE: Mayor Barlup led those present in the Pledge of Allegiance.
RESIGNATION FROM BOROUGH COUNCIL: Mr. Hamberger read a letter of resignation from Andrew “A.J.” Benchoff. Councilman Cook made a motion to accept Mr. Benchoff’s resignation. Councilman Mumma seconded; the motion passed unanimously.
Mr. Hamberger reviewed the procedure for filling the vacancy – Borough Council has thirty (30) days to fill the position; if they have not filled the vacancy within that time period, the Vacancy Board has fifteen (15) days to fill it; if the Vacancy Board does not fill the position within that timeframe, the matter will go to the Franklin County court system for an appointment to be made.
APPROVE MINUTES: Councilman George made a motion to approve the minutes of the April 20th regular meeting and the May 4th public hearing/regular meeting, as written. Councilman Cook seconded; the motion passed unanimously.
ACCEPT REPORTS: Councilman George made a motion to accept the reports of the Code Enforcement Officer, Fire Chief and Police Chief, as presented. Councilman Mumma seconded; the motion passed unanimously.
COMMITTEE REPORTS
PERSONNEL COMMITTEE: Councilman Mumma noted that the Personnel Committee is recommending the promotion of Patrolman John Shindledecker to the position of Corporal in the Police Department.
PROPERTY AND PUBLIC SAFETY COMMITTEE: No report.
STREET COMMITTEE: Councilman George acknowledged receipt of a letter from Beverly Kesselring regarding her request for a trash container to be installed in front of her residence, as well as a Handicapped Parking Space Application for V-Ann Staley. These matters will be discussed at the Street Committee’s next meeting.
INTERGOVERNMENTAL COMMITTEE: No report.
DOWNTOWN REVITALIZATION AND FINANCE COMMITTEE: No report. Councilman Cook reported that the Committee’s next meeting will be held on Monday, May 23rd, at 7:00 p.m.
MAYOR’S REPORT: The Mayor’s Report was as follows –
“There are several items I’d like to announce this evening:
First, Law Enforcement Sunday was celebrated here in Waynesboro by a special service at the Grace Brethren Church. The pastor, Roger Myers, serves as a volunteer chaplain to the Waynesboro Police Department and is a real asset to us. He accompanies the officers on patrol and provides a positive role model to them. Chief Shultz and his wife, Cpl. Kurt Wagaman and his family, and Jackie and I were among those who joined in the service of recognition of our law enforcement agencies.
Two other agencies, the Welfare Association and the Human Services Center, are the recipients of the letter carriers’ drive to “Stamp Out Hunger”. Citizens were asked to place non-perishable food items by their mailboxes where they were picked up by the postal workers and delivered to the local food banks.
Tomorrow, the Waynesboro Ambulance Squad will officially kick-off their building project on West Main Street and Tritle Avenue. This is a very special occasion and I would urge all members of Council to make every effort to support this event.”
PUBLIC COMMENT - ITEMS ON AGENDA: None.
VOTING ON ITEMS FROM COMMITTEE REPORTS: Councilman Mumma made a motion to appoint John Shindledecker to the position of Police Corporal. Councilman Cook seconded; the motion passed unanimously.
UNFINISHED BUSINESS
CONSIDER ORDINANCE NO. 1027 (REZONING ON DICKINSON AVENUE) FOR ADOPTION: Kevin Grubbs noted that a public hearing was held on May 4th regarding the proposed rezoning on Dickinson Avenue from RL to HO. Proposed Ordinance No. 1027 was advertised in The Record Herald and is offered for Council’s consideration. Councilman George made a motion to adopt Ordinance No. 1027. Councilman Cook seconded; the motion passed unanimously.

DISCUSSION ON HOLLENGREEN FARM DEVELOPMENT: Kevin Grubbs noted that Borough Council held a public hearing regarding the Hollengreen PRD on May 11th, and the Waynesboro Planning Commission has recommended tentative plan approval contingent on the following conditions: (1) all State and County permits are received; (2) subject to the bridge design approval from the Borough consultant; and (3) no development may begin until the above items are completed. Councilman Cook made a motion to grant tentative plan approval of the Hollengreen PRD. Councilman Mumma seconded.
Councilman George noted that concern was expressed the previous week regarding the spring on the Hollengreen property and the individuals who get their water from that source. Representatives from Brim Builders assured Council members that all necessary precautions will be taken to ensure protection from any construction in the near proximity. Kevin Grubbs also noted that a full-time inspector will be on-site at all times once they get to the development phase. Additional discussion regarding the spring continued, however Borough Solicitor Lloyd Reichard informed Council that this is a private matter between the Hollengreen Development owners and the residents who are utilizing the spring.
Councilman George questioned what procedure is followed if any historical artifacts are found in the area during excavation/construction. Brian McNew stated that any findings would be reported to him immediately, and he would subsequently contact the state for their inspection.
A vote on the motion was then called. The motion passed unanimously.
NEW BUSINESS
NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS): Mr. Hamberger informed Council that NIMS is a comprehensive emergency management system that has been implemented throughout the country to ensure that all emergency management systems are using the same terminologies and procedures. Borough staff and officials must take a training course by September 30, 2005 in order to be in compliance with federal regulations. Mr. Hamberger reported that he has already taken the course on-line, and will be working with department heads to schedule training sessions for personnel in the police, fire, maintenance and administrative departments in either June or July. He is attempting to confirm the need for elected officials to also complete the course.
GOLF CART RATES: Mr. Hamberger noted that the Recreation Board is recommending that a reduced rate be established for single-person cart riders (excluding weekends and holidays). Councilman George made a motion to approve the recommendation, as presented. Councilman Cook seconded; the motion passed unanimously.
NORTHSIDE POOL SMOKING REGULATIONS, RENTAL RATES AND END-OF-YEAR RECOMMENDATIONS: Mr. Hamberger noted that the Waynesboro Recreation Board was asked for input/recommendations on ways to make Northside Pool more effective this year. They have spent many hours reviewing the current Rules and Regulations, updated the personnel system, and hired a good staff. He reported that a staff meeting will be held the following evening at Northside Pool, and the pool will open on Saturday, May 28th.
After much review and discussion, the Recreation Board has recommended the following items:
1. Increase the fee charged for renting Northside Pool from the current rate of $175.00 to $225.00; and reduce the fee charged for each additional person exceeding 100 from the current rate of $1.50 per person to $1.00 per person.
2. As an incentive for guards to remain through the Labor Day weekend, increase the hourly compensation of each guard available for all three days (Saturday, Sunday and Monday) by $1.00.
3. Amend the smoking policy to designate a smoking area in a grassy area at the front entrance to the pool, within sight of the cashier, including a seating area and “butt” cans for those wishing to smoke.
4. Purchase staff shirts for all persons employed at Northside. (The Board does not recommend the Borough purchase suits for guards, however has instructed management to require a specific color of suit be worn.)
Councilman George made a motion to approve the recommendations from the Recreation Board with regard to Northside Pool, as outlined. Councilwoman Newcomer seconded. Mr. Hamberger provided a clarification on the pool rental times (7-10 p.m., when the pool is closed to all other patrons). The motion then passed unanimously.
REQUEST FROM LIBRARY FOR REMOVAL OF BUILDING: Mr. Hamberger presented correspondence from the Alexander Hamilton Memorial Free Library Board requesting that the Borough remove the block building at the rear of their property to provide for additional parking. It was noted that the Maintenance Department could do the work sometime this summer. Councilman Cook made a motion to remove the building as soon as possible. Councilman Mumma seconded; the motion passed unanimously.
PUBLIC IN ATTENDANCE - NON-AGENDA ITEMS: Carroll Woodring (C & W Builders), 5010 Stamy Hill Road, was present. He noted that he has been contracted to demolish the building at 23-25 S. Church Street and would like to close the alley (behind the Eagles Club) during working hours (7 a.m. to 5 p.m.) Mr. Woodring assured Council that the alley will be re-opened during the evening hours. It was noted that Mayor Barlup has the authority to close streets/alleys, and Mr. Barlup stated his agreement. Police Chief Shultz and Maintenance Superintendent Denny Benshoff were asked to provide the appropriate signs for the area.
AWARD BIDS - STREET RECONSTRUCTION: Councilman George noted that bids were opened for the street reconstruction projects on May 17th. He made a motion to award Contracts #1 and #2 to the low bidder, Fayetteville Contractors. Councilman Cook seconded; the motion passed unanimously.
FRANKLIN COUNTY COUNCIL OF GOVERNMENTS: Mr. Hamberger noted that he received information on membership in the Franklin County Council of Governments. He explained that Waynesboro had previously joined the COG by resolution, however an ordinance agreeing to their by-laws is now required for membership. He noted that he is working on a joint advertisement with several other municipalities. Councilman George made a motion to authorize advertisement of a proposed ordinance for adoption at Council’s next meeting. Councilman Cook seconded; the motion passed unanimously.
“ELECTED OFFICIALS LUNCHEON” HOSTED BY THE DEPARTMENT OF EMERGENCY SERVICES AND THE SOUTH CENTRAL REGIONAL COUNTER-TERRORISM TASK FORCE: Council members are invited to attend an “Elected Officials Luncheon” on June 22nd from 11 a.m. to 1:30 p.m. at the Orchards Restaurant in Chambersburg. Those interested in attending were asked to contact Melinda Knott by June 1st.
MUNICIPAL HEALTH INSURANCE CONSORTIUM MEETING (JUNE 2, 2005): Mr. Hamberger noted that, due to the ever-increasing cost of health insurance, the Borough had been working on a multi-jurisdictional insurance program which seemed to have “hit a brick wall”. However, Benecon is proposing another concept that involves self-insurance. Waynesboro will host a meeting regarding the matter in Borough Hall on June 2nd at 7:00 p.m. He recommended that members of the Personnel and Finance Committees attend.
Mr. Hamberger requested that a brief executive session be held following the meeting to discuss a personnel matter.
PAY BILLS: Councilman Cook made a motion to approve the payment of Voucher List VL-05-14. Councilman Mumma seconded; the motion passed unanimously.
COUNCIL AND STAFF COMMENTS: Kevin Grubbs noted that, on November 17th, 2004, Borough Council approved a subdivision for Thomas Painter on State Hill Road. (This was a minor side-lot subdivision for a utilities right-of-way.) After approval, the plan must be recorded at the Courthouse within ninety (90) days, however the property owner was unable to do so in the allotted time period. Accordingly, a re-dated copy of the plan, executed by the Council President, is required for recording purposes only. Mr. Grubbs confirmed that the subdivision has not changed in any way. Councilman George made a motion to authorize the Council President to execute a re-dated copy of the subdivision plan approved for Thomas Painter on November 17th. Councilman Cook seconded; the motion passed unanimously.
With regard to the NIMS program, Fire Chief Ron Flegel reported that two classes were held recently in the Virginia Avenue Fire Station. A total of sixty (60) individuals, from both the Fire and Police Departments, completed the course. He will provide a list of the additional upcoming classes to Mr. Hamberger.
Councilman George congratulated Allen Berry and Jason Stains for their success during the recent primary elections and is looking forward to working with them both. He urged them to attend future committee meetings to gain perspective which will be useful when they officially take office in January.
EXECUTIVE SESSION: Council adjourned to executive session at 8:12 p.m. to discuss personnel matters, and reconvened to regular session at 8:35 p.m.
Councilman George made a motion to authorize an additional thirteen (13) weeks of disability pay for Merle Bowders – his insurance will also continue. Councilman Mumma seconded; the motion passed unanimously.
Having no further business to discuss, the meeting adjourned at 8:37 p.m.
